विश्व हिन्दू परिषद् कार्याध्यक्ष श्री आलोक कुमार के खिलाफ एफआईआर का आदेश रद्द हर्ष मंडेर ने की थी एफआईआर की मांग

दिल्ली, शुक्रवार 21 जुलाई 2023 - दिल्ली उच्च न्यायालय ने आज एक विस्तृत आदेश से विश्व हिन्दू परिषद् के कार्याध्यक्ष श्री आलोक कुमार, सीनियर एडवोकेट के खिलाफ एफआईआर दर्ज करने के निचली कोर्ट के आदेश को निरस्त कर दिया।
जुलाई 2019 में पुरानी दिल्ली के लाल कुआँ में कुछ मुसलमान लड़को ने एक हिन्दू मंदिर को नुकसान पहुँचाया। भगवान की कुछ मूर्तियों को भी तोडा गया। स्वाभाविक ही हिन्दुओं ने इसका विरोध किया और विश्व हिन्दू परिषद् ने इस विरोध का नेतृत्व किया।
सोनिया गाँधी के किचन कैबिनेट के सदस्य रहे हुए श्री हर्ष मंडेर ने दिल्ली पुलिस को एक पत्र लिखा जिसमे कहा कि विश्व हिन्दू परिषद् की एक सभा में काशी से आये हुए एक सन्यासी ने भड़काऊ भाषण दिया है। मंडेर ने उनके खिलाफ एफआईआर दर्ज करने की मांग की। इस पत्र में श्री आलोक कुमार का नाम भी नहीं था। पुलिस ने जांच-पड़ताल के बाद पाया कि सन्यासी के भाषण में आपत्तिजनक कुछ नहीं था।
मंडेर ने फिर कोर्ट से दर्खास्त की कि वह पुलिस को एफआईआर दर्ज करने का आदेश दे। इस दर्खास्त में उन्होंने श्री आलोक कुमार का भी नाम जोड़ दिया। हालाँकि मंडेर ने याचिका में न यह कहा कि श्री आलोक कुमार ने उस सभा में कोई भाषण दिया था न ही यह की वह सभा में उपस्थित थे और न यह की यह सभा उन्होंने आयोजित करवाई थी। याचिका में केवल यह लिखा था कि श्री आलोक कुमार विश्व हिन्दू परिषद् के कार्याध्यक्ष है। इतने पर भी मैजिस्ट्रेट ने यह आदेश दे दिया कि उनके खिलाफ एफआईआर दर्ज की जाए। श्री आलोक कुमार ने इस आदेश को हाई कोर्ट में चुनौती दी। पहली ही सुनवाई में कोर्ट ने एफआईआर पर रोक लगा दी।
इस मामले का पूरा निर्णय आज शुक्रवार 21 जुलाई 2023 को सुनाया गया है। दिल्ली हाई कोर्ट ने अपने आदेश में श्री आलोक कुमार के खिलाफ एफआईआर दर्ज करने के आदेश को रद्द कर दिया है।
हाई कोर्ट ने पाया कि याचिका में श्री आलोक कुमार के खिलाफ कोई भी आरोप नहीं है। अगर मंडेर की याचिका में लिखी सारी बात को सच भी मान लिया जाये तो भी श्री आलोक कुमार के खिलाफ कोई दोष नहीं बनता। हाई कोर्ट ने कहा कि अगर सभा में दिए भाषणों से हिन्दू मुसलमानों में कुछ वैमनस्य न हुआ हो तो भी एफआईआर वगैरह के आदेश से यह वैमनस्य फैलने की परिस्थितियां बन सकती है। न्यायालयों को अपने आदेश पारित करते समय सतर्कता बरतनी चाहिए।
माननीय उच्च न्यायालय का आज का यह निर्णय सोनिया गांधी के चाटुकार हर्ष मंडेर के साथ उन सभी हिंदू द्रोहियों व देश विरोधियों के मुंह पर गहरा तमाचा है जो राष्ट्रवादी शक्तियों को अपनी कलुषित मानसिकता का शिकार बनाने के प्रयासों में सतत सक्रिय रहते हैं।
Order of FIR against shri Alok Kumar, demanded by Harsh Mander canceled
New Delhi, Friday July 21, 2023 - The Delhi High Court today, in a detailed order, set aside, the lower court's order for registration of FIR against shri Alok Kumar, Senior Advocate & Working President of Vishwa Hindu Parishad. In July 2019, some Muslim boys vandalized a Hindu temple at Lal Kuan in Old Delhi. Some idols of Gods were also broken. Naturally Hindus opposed it and Vishwa Hindu Parishad led this protest.
Shri Harsh Mander, who was a member of Sonia Gandhi's kitchen cabinet, wrote a letter to the Delhi Police, in which he said that a sanyasi from Kashi has given a provocative speech in a meeting of Vishwa Hindu Parishad. Mander demanded registration of an FIR against him. The name of shri Alok Kumar was also not there in this letter. After investigation, the police found that there was nothing objectionable in Sanyasi's speech.
Mander then requested the court to order the police to register an FIR. He also added the name of Shri Alok Kumar in this application. However, Mander did not state in the petition that shri Alok Kumar had given any speech in that meeting, nor that he was present in the meeting, nor that he had organized this meeting. It was only written in the petition that shri Alok Kumar is the working president of Vishwa Hindu Parishad. Despite this, the magistrate ordered that an FIR be registered against him.
Shri Alok Kumar challenged this order in the High Court. In the very first hearing, the court stayed the FIR. The complete decision of this matter has been pronounced today, Friday 21 July 2023. Delhi High Court in its order has quashed the order for registration of FIR against shri Alok Kumar.
The High Court observed that there was no allegation against shri Alok Kumar in the petition. Even if everything written in Mander's petition is to be accepted as true, no blame can be made out against shri Kumar. The High Court said that even if there was no enmity between Hindus and Muslims due to the speeches given in the gathering, then even by the orders of FIRs etc., conditions may be created for this enmity to spread. Courts should exercise caution while passing their orders.
Today's decision of the Honorable High Court is a deep slap on the faces of Sonia Gandhi's sycophants Harsh Mander and all those anti-Hindus and anti-nationals who are continuously active in their efforts to make the nationalist forces victims of their tainted mentality.
